1. Definitions
- Mechanic On The Go (MOTG): Mechanic On The Go Auto Workshop, its management, employees, agents, or authorized representatives.
- Customer: Any individual, organization, or entity engaging MOTG for inspection, repair, or related service.
- Vehicle or Item: Any vehicle, engine, or mechanical/electrical component handled by MOTG.
- Services: Diagnostic, repair, inspection, towing, delivery, maintenance, and advisory activities performed by MOTG.
- Invoice / Job Card / Quotation: Official documentation summarizing work scope, estimate, and terms.
2. Scope of Agreement
- These Terms apply to all services rendered — workshop, customer location, or affiliate partners.
- Any modification not in writing and signed by management is invalid.
- Private or informal arrangements between staff and customers are not recognized.
3. Formation of Contract
A binding contract is formed once a Customer either signs or accepts a quotation/invoice/job card or makes a payment/deposit. Payment or authorization constitutes full acceptance of these Terms.
4. Quotation Validity and Price Review
All quotations, invoices, and estimates are valid for seven (7) days. After this period, prices may be reviewed due to market or currency fluctuations. Revised estimates will be communicated before the continuation of work.
5. Deposit, Payment, and Release Policy
- A minimum non-refundable deposit of seventy-five percent (75%) of the total estimate is required before commencement.
- MOTG reserves the right to retain up to 75% as compensation for administrative, diagnostic, or procurement costs incurred before cancellation.
- For imported parts or specialized jobs, full (100%) advance payment may be required.
- The remaining twenty-five percent (25%) must be paid immediately upon completion and before release.
- No vehicle or item shall be released until all invoices, including storage or administrative costs, are cleared in full.
6. Non-Refund Policy
- All payments made for parts, labour, diagnostics, inspection, call-out, booking, or service fees are strictly non-refundable once a booking is confirmed, payment is made, or work has been scheduled, regardless of whether physical work has commenced.
- Where a Customer cancels a repair or service after payment but before physical work begins, MOTG reserves the right to retain up to seventy-five percent (75%) of the total estimate as compensation for administrative time, scheduling, diagnostic preparation, manpower allocation, logistics, and opportunity cost.
- For imported parts or specialized jobs, full (100%) advance payment may be required.
- Inspection, call-out, and booking fees are automatically forfeited upon cancellation and are not transferable to another job or date unless expressly approved by management in writing.
- Any exception to this policy is at the sole discretion of MOTG management and must be authorized in writing.
7. Proof of Ownership and Authority
- Customers must provide a valid government-issued ID and proof of ownership.
- Agents must provide written authorization.
- MOTG will not release property to any third party without proper verification.
- Customers shall indemnify MOTG against claims arising from false or disputed ownership.
8. Possessory Lien and Right of Retention
MOTG retains a possessory lien on all vehicles, engines, or parts in its custody until all outstanding payments, including storage or legal fees, are made in full. Only a valid court order or written indemnity accepted by management shall authorize release. This right is without prejudice to MOTG’s right to recover additional sums through legal means.
9. Storage, Abandonment, and Disposal
- Seven (7) days of free storage after notification of completion.
- Thereafter: ₦5,000/day for vehicles, ₦2,000/day for loose parts.
- After thirty (30) days of non-collection, MOTG may issue a 21-day notice via SMS, email, or registered mail.
- MOTG reserves the right to sell, scrap, or dispose of the item thereafter.
- Sale proceeds shall offset outstanding costs; any balance held for ninety (90) days before forfeiture.
- All disposal documentation and evidence of notice shall be maintained for record.
10. Job Authorization, Variations, and Communications
- Every job must be authorized in writing or via verified electronic approval.
- Additional work or variations must be confirmed in writing.
- Official communications will be via designated business channels.
- Customers must keep their contact details accurate and reachable.
11. Home, Office, and On-Site Inspections
Mobile/on-site services are by request and scheduling only. Call-out/inspection fees apply and are non-refundable. Customers must ensure safe and accessible work environments. MOTG is not liable for damage arising from unsafe conditions, third-party interference, or negligence. Technicians are not authorized to accept cash beyond officially invoiced amounts. Payments must be made to the company’s official bank account. Parts removed during on-site repair remain property of MOTG until full payment. If towing to workshop is required, additional charges apply and workshop terms take effect upon arrival.
12. Inspection, Diagnosis, and Acceptance
Inspection/diagnostic fees are distinct from repair charges. Customers must inspect vehicles upon collection. Complaints must be made in writing within 48 hours of collection; after that, the job is deemed accepted and all claims waived. MOTG is not responsible for malfunction or damage after the vehicle leaves custody.
13. Limitation of Liability
MOTG’s total liability for any loss, damage, or claim shall not exceed ₦500,000. For luxury or insured vehicles, the Customer agrees to provide valid insurance coverage; otherwise, liability remains limited to ₦500,000. MOTG shall not be liable for consequential losses, loss of profit, or third-party claims. Customer-supplied parts are at the customer’s sole risk.
14. Customer Conduct and Safety
Customers must not interfere with staff or operations. Unauthorized entry into restricted areas is prohibited. MOTG may refuse service to persons engaging in harassment, abuse, or unsafe behavior.
15. Staff and Third-Party Interference
Customers shall not privately hire MOTG staff for off-record jobs. Such conduct constitutes a material breach of these Terms, voiding any warranties or service guarantees. MOTG is not liable for losses from unauthorized engagements.
16. Police, Government, and Court Orders
MOTG will only release property on valid court orders, police warrants, or written indemnity. Customers shall indemnify MOTG against losses from ownership disputes or improper law enforcement interference.
17. Force Majeure
MOTG is not liable for delays or damages arising from events beyond its control, including strikes, supply shortages, power failures, import restrictions, acts of God, or government actions.
18. Confidentiality and Data Protection
MOTG acts as a Data Controller under the Nigeria Data Protection Act (NDPA). Customer information is collected and stored securely for the purpose of providing services. Data will not be shared except as required by law or for legitimate service delivery.
19. Intellectual Property
All reports, diagnostics, quotations, and service materials remain the intellectual property of MOTG. Reproduction or use for competitive or unauthorized purposes is strictly prohibited.
20. Indemnity Clause
The Customer shall indemnify and hold MOTG harmless from any claim, cost, or liability arising from inaccurate information, unauthorized use of third-party parts, or actions of third-party contractors engaged by the Customer.
21. Part Ownership Clause
All parts supplied and installed by MOTG remain the property of MOTG until full payment is received. MOTG reserves the right to remove or disable such parts in case of default.
22. Warranty Clause
Repairs carried out by MOTG include a seven (7) day functional warranty limited to workmanship only. The warranty does not apply to customer-supplied parts, overheating, accidents, misuse, or third-party tampering.
23. Evidence and Documentation
All vehicles are photographed and/or recorded before commencement of work. Such documentation serves as evidence of condition and may be used in dispute resolution.
24. Public Image Clause
Customers agree not to publish or distribute defamatory or misleading information about MOTG or its staff. Breach of this clause entitles MOTG to seek damages or legal remedy.
25. Dispute Resolution and Jurisdiction
All disputes shall first be referred to arbitration in Lagos, Nigeria, under the Arbitration and Conciliation Act. MOTG reserves the right to seek urgent relief in a court of competent jurisdiction. Nigerian law shall govern these Terms.
26. Severability
If any clause is found invalid or unenforceable, the remainder of the Terms shall continue in force.
27. Updates and Version Control
Only the version of these Terms in effect at the date of job authorization or payment shall apply to that transaction. MOTG may revise these Terms periodically, with updates published at www.mechaniconthego.com.ng/terms.
28. Acceptance
By signing a job card, quotation, or invoice, or by making payment, the Customer confirms they have read, understood, and accepted these Terms as binding and enforceable.
